Dispute Type 01

Pounding in Kitchen During Morning & Night

The sounds generated by, pounding activity in kitchen, is akin to that generated, when construction work is in progress.

Humans need a relaxed mind, to induce sleep.

Sleep is said to be the foremost gift, by almighty, to humans.

Lack of sleep, is the origin of multiple diseases & causes detoriation, in existing diseases. Lack of sleep can, also not only harm organs, but can also cause, a near death scenario or death.

Also sudden loud sound, in regularity, more during natural hours of silence, can cause, heart or brain stroke.

Now days people sleep late. Specially in Large Cities, the engagement, is such that, early to bed & early to rise, is a challenge.

Even thousands are engaged, in offshore work requiring night shifts.

If Sleep is disturbed in regularity by irritating avoidable sounds, at avoidable natural hours of peace, the affected person over a period of time, would develop phobia & suffer from extreme loss of sleep. It's akin to a scenario, wherein someone is regularly pinched during sleep & woken up. As a consequence, over a time period, he/she, will tend to loose on sleep, fearing of the sudden pinch.

So inside flat regular activities, which cause sounds, akin to, that originating from - Construction Activities, have to be regulated to a very small window.

Ideally time for such, heavy noise generating, regular work, should be - PM.12 to PM. 02, when those who are engaged in normal day work or even offshore work, which requires night shifts, are not sleeping.

Pounding work in Kitchen, can be done in the available time window & thereafter - food can be refrigerated.

Example - If Tea has to be prepared for (6) times a day & Ginger with Cardamom, has to be pounded, then instead of doing it for (6) times from - Early morning to Afternoon to Late night, one can do it for once, around afternoon & refrigerate the crush, for use, untill next day afternoon.

Dispute Type 02

Dragging of Furniture During Morning & Night

The sounds generated by, furniture dragging activity, is akin to that generated, when construction work is in progress.

Silicon Leg Covers, are a sure way to prevent, heavy sounds, generated by moving furniture.

Dispute Type 03

Encroachment of Common Space

Common areas include - corridors, staircases, terraces, parking zones, lift room and gardens.

Some residents, extend gates; put heavy items as Cupboards; Fix Storage to wall outside Flat; Occupy open space attached to Flats, by creating a opening from flat.

What some flat owners do, if is done by, all flat owners, the Apartment Complex, will become choked of space.

Dispute Type 04

Illegal Sale of Common Space

There are instances, wherein common space is, transferred by Deed of Conveyance, from first owner to second owner.

Although the portion of common space being transferred, is not part of the mother deed, of the first buyer, the same, is incorporated in the subsequent Deed of Conveyance and illegal rights created in name of second buyer and the spoils of the, illegal act are shared between the, first and second buyer.

In small Apartment Complexes, flat owners do not want to pick up a fight and also lack in resources to initiate litigation, hence enabling fraudsters go, scot free.

Dispute Type 05

Non Payment of Monthly Maintenance Charges

Revenue from Monthly Maintenance Charges, is as important to Housing Society, what Oxigen is to, any living being.

Monthly Maintenance Charges keeps indispensable inputs going - Security, Common area Electricity, Commercial water, Cleaning, Essential Repairs, among other cost heads, required for - day to day, running of - Apartment Complexes, cannot function without being funded.

Any stoppage of above inputs, would cause immense hardship to other residents.

However, every Apartment Complex, has minimum (10%) residents, who are habitual defaulters, on - Monthly Maintenance Charges.In large Complexes, putting defaulters to task is possible. However in - Small & Mid size Complexes, such defaulters, go scot free.

Dispute Type 06

Non Payment of Charges Towards Special Facilities & Services

Special - Facilities & Services, include - Community Hall, Common Area, Club House, Power Consumption from Power Backup.

Revenue from Special Usage Charges, keeps these, special - facilities & services going.

Any stoppage of, such services & facilities, would cause immense hardship, to other residents.

However, every Apartment Complex, has minimum (10%) residents, who are habitual defaulters, on - such charges.

In large Complexes, putting defaulters to task is possible. However in - Small & Mid size Complexes, such defaulters, go scot free.

Dispute Type 07

Throwing Garbage in Common Space

This is a very prevalent nuisance.

At times, garbage on, window sun shades of flats below, can very clearly point to the defaulters.

What the defaulters, do not understand, that if similar indulgence is done by majority of flat owners, the Apartment Complex will resemble a Garbage Landfill.

Dispute Type 08

Loud Music, TV & Audio Systems

Excessively loud music, television, speakers, musical instruments, or other audio equipment, particularly during, morning, night, or designated quiet hours, causing disturbance to neighboring residents.

Dispute Type 09

Construction, Drilling & Renovation Noise

Drilling, hammering, wall cutting, tile breaking, welding, plumbing, or other renovation activities conducted during restricted hours, causing excessive noise, vibration, dust, and disturbance to surrounding flats.

Dispute Type 10

Water Leakage & Seepage

Water leakage, seepage, dampness, or flooding originating from an adjoining flat, bathroom, kitchen, balcony, terrace, or plumbing system, resulting in damage to walls, ceilings, flooring, electrical fittings, furniture, or other property.

Dispute Type 11

Unauthorized Renovation / Structural Alteration

Carrying out unauthorized structural modifications, demolition, extensions, enclosure of balconies, alteration of walls, plumbing changes, or other modifications, which are barred by law & also effect, structural stability of building.

Dispute Type 12

Pet-Related Nuisance

Failure to properly manage pets in common areas, including excessive barking, uncontrolled movement, fouling of corridors/lifts/staircases, aggressive behavior & having such pets, which can endanger human life.

Dispute Type 13

Parking Dispute

Unauthorized occupation of another resident's designated parking space, double parking, blocking driveways or access routes, parking in fire-access areas, visitor parking misuse, or parking vehicles in prohibited common areas. Also Guest parking vehicles in designated parking of other flat owners.

Dispute Type 14

Wrong Water Usage

Misuse of water sources. Using filtered water for washing cars. Drawing excess water, during private functions, in - Community Hall.

Dispute Type 15

Electricity / Common Utility Misuse

Drawing excess electricity, during private functions, in - Community Hall & hence putting heavy load on building supply facility.

Dispute Type 16

Lift Misuse / Lift Damage

Overloading & transporting heavy material.

Dispute Type 17

Security / Unauthorized Entry

Allowing unauthorized persons, vendors, domestic workers, delivery personnel, or vehicles into the premises, without following applicable security procedures, or bypassing visitor-registration requirements.

Dispute Type 18

Domestic Help / Staff Misconduct

This is primarily related to access of Resident only areas by, domestic workers & drivers.

Dispute Type 19

Children Playing // Common Area Nuisance

Children playing in prohibited areas & causing concern to their own safety & security.

Dispute Type 20

Electric Non Maintenance

Non Maintenance of - Electric infrastructure, either or both in - Common areas & Inside Flats, hence posing a fire risk.

Dispute Type 21

Commercial Activity

Operating offices, shops, workshops, warehouses, tuition centers, salons, restaurants, or other commercial activities from residential premises.

Dispute Type 22

Tenant Ascendants

Not verifying tenants & such tenants posing a security risk, to the Housing Society residents.

Dispute Type 23

Common Property Damage

Damage to corridors, walls, flooring, doors, lifts, lighting, landscaping or other common property.

Dispute Type 24

Fire Safety Violations

Storing combustible materials in common areas, obstructing emergency access, or undertaking activities that create a fire hazard.

Dispute Type 25

AC outdoor units

Installation of AC outdoor units, in a manner which encroach roofs & also non maintenance of - Outdoor units, which cause high pitched sound & also are a fire hazard.

Dispute Type 26

Common Area Misuse

Using Roofs & Corridors in a manner, which is not in compliance with basic rules. Example - drying clothes in roofs.

Dispute Type 27

Animal Feeding / Stray Animal Dispute

Disputes concerning feeding of stray animals either - inside or at close vicinity of - Apartment Complexes & hence leading strays invade Apartment Complexes & also grow in numbers.
